The Reason Jay-Z & Kanye West Are Being Sued

RumorFix has learned that rappers Kanye West and Jay-Z are being sued over swagger jacking a music sample from soul icon Syl Johnson.

The lawsuit, filed in Illinois federal court on Friday, alleges that Kanye and Jay used a portion of Syl's 1967 hit "Different Strokes" on their song "The Joy," which appeared on a deluxe edition of the rappers' best-selling Watch The Throne album.

The suit also claims that West originally attempted to sample the tune on his My Beautiful Dark Twisted Fantasy solo album, but was unable to get clearance in time to use it. The suit alleges West's decision to use the sample on another album without permission is an example of "knowing" and "willful" misappropriation.

The suit seeks to impound all the copies of Throne and requests a full accounting of sale and publishing money, along with punitive damages.
