RumorFix has learned exclusively that Teen Mom star Amber Portwood has NOT been charged with three counts of battery -- yet.

The Madison County District Attorney's office tells RumorFix that on Thursday the Anderson Police Department made recommendations -- but no formal charges have been filed.

That means TMZ, EOnline, Hollywood Life and other celebrity websites are wrong.

RumorFix spoke with Anderson PD spokesman Mitch Carroll who tells us the process of bringing formal charges could take days or weeks.

Carroll makes it clear that "Portwood has not been arrested," the next step is a warrant.

Carroll says after a seven-week investigation, they have probable cause to charge the 20-year-old with a misdemeanor and two felony counts relating to three assaults on her former fiance, Gary Shirley.

In Indiana, where Portwood lives, domestic abuse in the presence of a child is considered a felony. Portwood's arguments with Shirley were well documented on the MTV reality series. In one episode, their daughter, 2-year-old Leah, even told her mom to "be quiet."

MTV released this statement:"We are cooperating with all parties and hope for a quick and fair resolution that allows everyone involved to move forward in a positive manner."

Police say the alleged abuse occurred on July 14, July 18 and August 14. If convicted, Portwood could serve up to three years in jail and pay $10,000 in fines.
